1. Agreement to Terms

By accessing or using MatchMentum ("Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

MatchMentum is an AI-powered resume optimization platform that helps job seekers:

• Parse and analyze resume content
• Match profiles against job descriptions
• Generate tailored resumes and cover letters
• Optimize content for Applicant Tracking Systems (ATS)
• Store and manage job application documents

3. Subscription Plans and Pricing

3.1 Billing

• Subscriptions are billed monthly in advance
• Prices are in USD unless otherwise stated
• Payment is processed securely through Stripe
• Usage limits reset on your billing date each month
• We may change prices with 30 days' notice

3.2 Free Trial

New accounts receive a 7-day free trial with access to unlimited job analyses and 3 resume generations. No credit card is required to start a trial. At the end of the trial period, accounts are placed in a read-only state — you can view your history but cannot generate new content until you subscribe to a paid plan. Trial accounts may not be used to circumvent paid plan limits; creating multiple accounts to extend trial access is prohibited.

4. User Accounts

4.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You are responsible for all activities under your account
• One person may not maintain multiple trial or free accounts

4.2 Account Security

• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• We are not liable for losses from unauthorized use

5. Acceptable Use Policy

5.1 Permitted Uses

• Creating resumes and cover letters for job applications
• Analyzing job descriptions for personal use
• Storing your own professional documents

5.2 Prohibited Uses

You agree NOT to:

• Share your account with others
• Use the Service for illegal purposes
• Upload malicious code or viruses
• Attempt to reverse engineer or hack the Service
• Scrape or automate access to the Service
• Resell or redistribute our Service
• Generate content for others commercially without permission
• Upload content you don't have rights to
• Use the Service to generate spam or misleading content
• Circumvent usage limits or billing

6. AI-Generated Content

6.1 Content Accuracy

6.2 Your Responsibilities

• Verify Accuracy: Always review AI-generated resumes and cover letters
• Truthfulness: Ensure all content represents you truthfully
• Legal Compliance: You are legally responsible for the accuracy of your application materials
• No Guarantee: We do not guarantee that using our Service will result in job offers

6.3 Content Ownership

• You retain all rights to content you upload
• You own all generated resumes and cover letters
• We do not claim ownership of your documents
• We may use aggregated, anonymized data to improve the Service

7. Intellectual Property

7.1 Our Property

MatchMentum, including all software, design, text, graphics, and other content (excluding user content), is owned by us and protected by copyright, trademark, and other laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Cancellation and Refunds

8.1 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your billing period
• You retain access until the end of the paid period
• No refunds for partial months

8.2 Refund Policy

• 7-Day Money-Back Guarantee: Request a full refund within 7 days of your first payment
• Refunds beyond 7 days are at our discretion
• No refunds for accounts terminated for Terms violations
• Refunds processed within 5-10 business days

8.3 Downgrades

• You may downgrade at any time
• Downgrade takes effect at the next billing cycle
• Usage limits apply immediately upon downgrade
• Unused generations do not roll over

9. Termination

9.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support.

9.2 Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Your payment fails repeatedly
• We cease operating the Service

9.3 Effect of Termination

• You lose access to the Service immediately
• Your data will be deleted within 30 days
• You should export any important data before termination
• Termination does not affect any obligations that arose before termination

10. Disclaimers and Limitations of Liability

10.1 Service "AS IS"

10.2 No Guarantee of Results

We do not guarantee that:

• The Service will meet your requirements
• The Service will be uninterrupted or error-free
• AI-generated content will be accurate or error-free
• Using our Service will result in job offers
• Your data will never be lost (always keep backups)

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MATCHMENTUM SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from AI-generated content inaccuracies
• Damages exceeding the amount you paid in the last 12 months

11. Indemnification

You agree to indemnify and hold harmless MatchMentum from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit or generate

12. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms with a new "Effective Date"
• Sending email notification (for significant changes)
• Displaying a notice on the Service

Your continued use after changes indicates acceptance. If you don't agree, you must stop using the Service.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally for at least 30 days.

14.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court.

14.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to bring claims as a class action, collective action, or representative action.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and MatchMentum and supersede any prior agreements.
